Agreement

These terms govern your use of hernandomediallc.com, our booking and consulting services, and our text messaging programs, all operated by Hernando Media LLC ("Hernando Media," "we," "us"), St. Louis, Missouri. By using the website or services — including by texting our messaging program — you agree to these terms. If you do not agree, please do not use the services.

SMS messaging program terms

Hernando Media operates an assistant messaging program — a text-message-based chief of staff for our team and clients ("the program"). The following terms apply to all SMS communication with the program.

Program description

You can expect two kinds of messages:

• Conversational messages — replies to texts you send the program, in an ongoing two-way conversation (questions, requests, task coordination).
• Account and service notifications — proactive reminders, task updates, scheduling confirmations, and briefings related to your work with us.

The program does not send marketing or promotional messages.

How you opt in

You are enrolled in the program in one of two ways:

• You provide your mobile number to Hernando Media and expressly agree to receive text messages from the program; or
• You initiate contact by sending a text message to the program's number, which constitutes your consent to receive replies and related service notifications.

Consent to receive text messages is not a condition of purchasing any goods or services from Hernando Media.

Message frequency

Message frequency varies based on your interaction with the program. During an active conversation you may receive several replies in a session; proactive service notifications are typically up to 3 messages per day.

Message and data rates

Message and data rates may apply. Check with your mobile carrier for details on your plan.

Opting out

You can cancel the SMS service at any time. Reply STOP to any message and you will receive a one-time confirmation that you have been unsubscribed; after that, you will receive no further messages from the program. To rejoin, reply START or sign up again as you did the first time.

Carriers

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator.

Privacy

Our privacy policy describes how we handle your information, including your mobile number and message content. In short: no mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and your opt-in data and consent will never be sold or shared with third parties.

Automated responses

Replies from the messaging program are generated by automated systems, including artificial-intelligence services. They are provided for convenience and coordination, may occasionally be inaccurate or incomplete, and do not constitute legal, financial, medical, or other professional advice. Verify anything consequential with a human before acting on it.

Acceptable use

You agree not to use the website or messaging program to:

• Send unlawful, abusive, or harassing content;
• Attempt to disrupt, probe, or gain unauthorized access to our systems or data;
• Misrepresent your identity or enroll a phone number you are not authorized to use.

We may suspend or remove access to the program at our discretion.

Services and bookings

Consulting engagements are governed by the specific terms agreed in writing for each engagement. Booking a call through the website does not by itself create a client relationship.

Intellectual property

The website, its content, and the Hernando Media name and marks are owned by Hernando Media LLC. You may not reproduce or use them without permission, except as permitted for personal, non-commercial reference.

Disclaimers and limitation of liability

The website and messaging program are provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, Hernando Media LLC will not be liable for indirect, incidental, special, or consequential damages arising from your use of the website or messaging program. Our total liability for any claim relating to the services will not exceed the amount you paid us in the twelve months preceding the claim.

Governing law

These terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in St. Louis, Missouri.

Changes to these terms

We may update these terms from time to time. The current version will always be posted at this page with its "last updated" date. Continued use of the services after changes take effect constitutes acceptance.
